Kat’s Collection LLC dba Angelina Belle Boutique Brand Rep Terms & Conditions

BY JOINING OUR VIP INFLUENCER BRAND REP PROGRAM, YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THAT YOU AGREE TO BE LEGALLY RESPONSIBLE FOR EACH AND EVERY TERM AND CONDITION.

The following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant” or “Angelina Belle Boutique”) and an affiliate (“you” or “affiliate” or “brand rep” or “brand ambassador” or “VIP Influencer” or “VIP Influencer Brand Rep”) who pays a monthly fee of $14.99 for a discount on select merchandise from merchant’s store and who refers customers to use product or service from the merchant.

By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and is bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an Affiliate/Brand Rep or participate in the Program in any manner.

As an authorized representative of Angelina Belle Boutique, you agree to abide by the terms and conditions contained in this Agreement. Your participation in this Brand Representative Program (the “Representative Program”) is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to Angelina Belle Boutique by your own website, social media channels or personal referrals. By joining the Representative Program, you indicate your acceptance of this Agreement and its terms and conditions. Angelina Belle Boutique reserves the unilateral right to periodically update these terms. 

  1. Approve or Reject the Registration

We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

 

  1. Relationship of the Parties

As a Representative, you are serving as an independent contractor, and nothing in this Agreement or the Representative Program in general creates an agency, franchise, partnership, sales representative or employment relationship between you and Angelina Belle Boutique. You have no authority to make or accept any offers or representations on our behalf. 

 

  1. Affiliate Links and Coupon

Affiliate link is automatically generated, but you can also generate an affiliate link for a specific product or collection. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.

Affiliate might or might not be assigned to one coupon code. If customer both click on the affiliate link and use coupon code, you will not receive a double commission. If you’re not assigned a branded coupon, then you’re not allowed to promote the coupon.

Affiliate may also advertise merchant website on online channels such as personal website/blog, social media such as Facebook, Instagram,... or offline classified channel ads, magazines, and newspapers.

 

  1. Commissions and payment

Refer any customer to make a purchase on our website, and you will earn a commission.   

Representative will receive commissions for successful payments made by customers referred to Angelina Belle Boutique by Representative. The Angelina Belle Boutique Affiliate program rewards  Affiliates with 20% commission on all COMMISSIONABLE revenue. Commissionable revenue is defined as revenue from referral sales excluding gift card usage (monetary or promotional), shipping costs, and taxes.  Qualifying Purchases that result in chargebacks or refunds will not be paid to Representative.

For an Affiliate to receive a commission, you need to specify the payment details on Settings. Payment schedule will be notified on Affiliate Guide page. In order to be eligible for the Representative Program, you must also create a PayPal account and agree to the Terms of Use of PayPal, our payment processor for the Representative Program. We reserve the right to approve or reject any Representative Program registration in our sole and absolute discretion. 

Payments will only be sent for transactions that have been successfully completed. Use of the Affiliate Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission is displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.

 

  1. Discount

 

Representatives will be eligible for a 40% discount on personal purchases of select merchandise from Angelina Belle Boutique in months in which Representative has paid the $14.99 subscription fee.  Specifically, merchandise from the VIP Influencer Collection are the only items for which this discount may be applied, without exception.

 

  1. Your website and social media channels

 

Affiliate hereby represents and warrants that Affiliate will be solely responsible for his/her website, and social media channels, independent of the link provided by Angelina Belle Boutique, including its development, operation and maintenance and all data, content and materials that appear on or within it. Angelina Belle Boutique is not and shall never be liable for any claims, damages, losses, liabilities, fines, penalties, costs and expenses relating to (a) your website/social channels or any data, content or materials that appear on your website/social channels; (b) the use, development, design, manufacture, production, advertising, promotion or marketing of your website/social channels; (c) your use of any content; and (d) your violation of any term or condition of this Agreement. 

You are prohibited from using any of Angelina Belle’s trademarked or copyrighted terms as part of the domain or sub-domain for your website, website name or social media handles.

You are prohibited from posting your Representative links on Angelina Belle Boutique’s Facebook page or other social media pages in an attempt to turn those links into referral sales. 

 

  1. Marketing tool

We encourage you to post unique content when sharing your affiliate link or discount code.  From time to time, we may also share promotional media such as banner, logo or specific collection promotion to you through Marketing tool tab. You can download the media or get the HTML embed code in order to share on affiliate channels.

 

  1. Network

If Network tab is activated, affiliate can invite others to become their downline affiliate. If any downline affiliate brings order to merchant shop, upline affiliate will also get network commission which depends on merchant settings.

To invite other affiliates into the system, share network link and any other affiliate who click on that link and sign up will become a downline affiliate.

 

  1. Cookie

We use a cookie to track individuals who have clicked on your link, so they need to be using cookies for us to track them.

If a person doesn't allow cookies or clears their cookies then we can't track them, and in this case we are unable to pay earnings on that person's activity.

Cookies day is stated on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the affiliate (There’s no need for the customer to click on the affiliate link again).

 

  1. Removal from Referral Program

If an affiliate wishes to be removed from the affiliate program, they can do so by contacting: info@angelinabelle.com.

 

  1. Inactive accounts

If we feel you are abusing your membership or not generating referrals we reserve the right to remove you from our affiliate/brand rep program.

 

  1. Liability

Angelina Belle Boutique will not be liable for indirect or accidental damages (loss of revenue, commissions) due to representative tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).  We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by Angelina Belle Boutique. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.
